section 1 general terms

• 1.1 overall
  1. all clients must be at least 18 years or older
  2. use of works outside of terms must have the artist's permission

  3. non-commissioned works may not be used or reposted publicly for any purpose

  see section 5.1 regarding character design artworks
  4. the artist reserves the right to refuse or cancel commissions anytime for any reason
• 1.2 restricted
  1. do not use any works for any generative ai or associated training
  2. do not use any works for nft/blockchain minting
  3. do not use any works for depiction or promotion of illegal or discriminatory behavior
  4. violation of any restriction will result in immediate blacklisting

section 2 rights and agreements

• 2.1 copyright
  1. copyright of all works produced and usage of any manner will remain with the artist
  2. the artist will not use commissioned works to create or sell merchandise
• 2.2 publication
  1. the artist reserves the right to publicly post completed works
  2. the client may request to be anonymous during publication
• 2.3 client permissions
  1. the client may use commissioned works for personal purposes
  2. the client may make minor alterations to commissioned works
  3. the client may physically reproduce commissioned works
• 2.4 limitations

  1. commissioned works may be used for commercial purposes with permission

     commercial use incurs an additional fee

• 2.5 crediting
  1. the client must credit the artist worldpillar wherever the work is seen

section 3 payment and pricing

• 3.1 payment
  1. all payments are in usd via paypal invoice
  2. all payments are due within 48 hours from invoice
  3. full payment for commissioned works will be taken in advance
• 3.2 pricing
  1. pricing for commissioned works are subject to change
  2. payment plans are available upon request if pricing is over 150 usd

section 4 cancellations

• 4.1 cancellation
  1. all character design sales are final

  2. cancellations may be requested at any time

     cancellations can not be reversed

  3. the client will not receive any usage rights of existing drafts
  4. only cancellations before the final sketch stage will be refunded
  5. artist initiated cancellations will be fully refunded

section 5 character designs

• 5.1 copyright
  1. the artist retains all rights of the original artwork and design concept

  2. the owner may use the original design artwork as if it was commissioned

     see section 2.3 regarding usage rights

  3. collaborative/closed species designs fall under the other designer's/owner's terms
• 5.2 owner permissions
  1. the owner has rights for personal use of the design

  2. the owner may use the design for commercial purposes with permission

     commercial use incurs an additional fee

  3. the owner may transfer the design and its rights to another individual

     co-ownership disputes will not be addressed

  4. the owner may make modifications to the design and its original artwork
• 5.3 resale
  1. trade, gifting, or resale of the design for any amount is allowed regardless of initial value
  2. the design once transferred still remain under these terms
• 5.4 limitations
  1. designs may not be used as a basis for closed/open species and sold for profit
  2. transferring ownership to a blacklisted user will result in an immediate blacklisting
